Official Rules. JCPenney "Superstar Dream Watch and Win" Instant Win Game ("Game"). No Purchase Or Payment Necessary To Enter Or Win. Purchase will not increase chance of winning. Open only to legal US residents, 21 or older. Void in Puerto Rico, Mexico, U.S. Territories and Possessions and where restricted or prohibited by law. 1. How to Play. From 2/19/04 through 2/29/04 ("Promotional Period"), you may obtain an official Superstar Dream Watch and Win game card during regular store hours at any participating JCPenney retail store, while supplies last. Limit one official game card per person/per day. Game ends 2/29/04 or when the supply of game cards is exhausted, whichever comes first. There are 2 ways to win: [A] Instant Win: With a coin, scratch the concealed area on the right half of your game card. If the message revealed states, "WINNER," you win a $20 instant prize. Detach the right half of your game card, sign your name on the back, and take it to the JCPenney Catalog Service counter for verification and redemption. All instant prizes must be claimed by 3/05/04. If your game card does not contain a WINNER message, you are not a winner of an instant prize. Be sure to retain the left half of your game card, because you are still eligible to play Superstar Dream Watch and Win for a chance to win the Grand Prize (see [B] below). [B] Watch and Win: Watch the Academy Awards® which will air on ABC Television at 5 p.m. PT/8 p.m. ET on 2/29/04 to see whether you are the Grand Prize winner. The Grand Prize winning code will be displayed in a JCPenney commercial during the Academy Awards® broadcast. Scratch off the concealed area on the left side of your game card. If the alpha-numeric code in the left half of your game card matches the code displayed in the commercial exactly and is in the exact same order in which it appears on your TV screen, you are the potential Superstar Dream Watch and Win Grand Prize winner, subject to verification and validation. If you are unable to watch the broadcast airing the Grand Prize winning code, you may go to www.jcpenney.com/superstar where the winning code will be displayed from the conclusion of the Academy Awards® broadcast to 3/7/04. Grand Prize Claim: If your game card contains the potential alpha-numeric winning code, mail your original signed game card along with a 3"x5" card with your hand-printed name, address, city, state, zip code and day and evening telephone numbers in a #10 envelope via REGISTERED MAIL, INSURED, RETURN RECEIPT REQUESTED to: JCPenney Grand Prize Claim, c/o Marden-Kane, Inc., Dept KP, 36 Maple Place, Manhasset, NY 11030; card must be received by 3/12/04. Potential claims are subject to verification and validation. Proof of mailing does not constitute proof of delivery. Retain a photocopy of your potential winning game card for your records. Facsimiles or photocopies of potential winning claims are void. Any potentially winning Grand Prize game card or $20 instant winning game card that is reproduced, illegible, tampered with, mutilated, changed in any way, or contains printing, or typographical errors, or is obtained outside legitimate channels is automatically void. Actual value of the Grand Prize may vary depending upon winner's point of departure and dates of travel. Certain travel restrictions may apply. Prize includes: round-trip first-class air transportation for 2 between the major US gateway airports nearest winner's residence and Hollywood, CA; first-class hotel accommodations for 4 nights; 2 tickets to the 2005 Academy Awards® Pre-show Red Carpet viewing area; and limo service for 5 days/4 nights. Winner and his/her guest must travel together sometime in February or March 2005 (exact date to be confirmed at time of awarding), and use the same itinerary. Winner and guest are responsible for obtaining all travel documents, including but not limited to any travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Ten thousand (10,000) First Prizes: JCPenney $20 Gift Card. ARV: $20 each. Odds: 1:1,000 Gift cards may be used to purchase JCPenney retail store, catalog and Internet merchandise and services and are subject to terms and conditions printed thereon. Total ARV of all prizes: $315,000. No prize, cash, substitutions, transfers or assignments allowed, except at the sole discretion of Sponsor, who reserves the right to substitute a prize of equal or greater value if a prize becomes unavailable. All taxes, fees and other expenses not specified herein, including without limitation, income taxes, related to the prize awarded and its receipt are the sole responsibility of the winner. If the Grand Prize remains unclaimed by 3/12/04 an alternate winner will be selected in a Second Chance Drawing from among all eligible entries received during the promotional period as outlined in Rule 5. Unclaimed First Prizes will not be awarded. By accepting a prize, winners agree to the use of their names and/or likenesses for advertising and promotional purposes, worldwide, and in perpetuity in any media, now known and hereafter devised (including and without limitation, the internet) without additional compensation, except where prohibited by law, and upon request provide consent to such use in writing unless prohibited by law. 4. Notification: The potential Grand Prize winner will be notified by certified mail, return receipt requested, and must complete and execute an affidavit of eligibility, provide his/her Social Security number (for the sole purpose of reporting the value of the prize to the Internal Revenue Service), IRS Form W-9 as well as a liability release and, where legal, a publicity release, all of which must be completed, signed and returned within 14 days of issuance or prize will be forfeited and awarded to an alternate selection. If the prize or prize notification is unclaimed, or returned as undeliverable, the prize will be forfeited and awarded to an alternate winner in accordance with the terms of Rules 3 and 5. Limit 1 entry per person regardless of method. Mechanically reproduced entries not eligible. Mail-in entries must be postmarked by 3/8/04 and received by 3/12/04. Potential winner will be selected in a random drawing from all eligible entries received on or about 3/15/04 by Marden-Kane, Inc., an independent judging organization whose decisions are final in all matters relating to this Game. Odds of winning the Grand Prize in the Second Chance Drawing depend on the actual number of eligible entries received. The potential winner will be notified by mail in accordance with the same terms and conditions as outlined in Rule 4. 6. If in Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Game, or if computer virus, bugs, unauthorized intervention, fraud or if technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Game, Sponsor reserves the right in its sole discretion to disqualify any individual who tampers with, or attempts to tamper with, the entry process, or to terminate entire Game or that portion of the Game relating to the suspected or actual tampering of the Game and conduct a random drawing to award prizes using all non-suspect, eligible claims received for the applicable prize level as of the date of such action. In the event the Game or any portion of the Game is terminated or modified prior to the stated expiration date; notice will be posted on http://www.jcpenney.com/superstar. Only the number of prizes stated herein will be awarded. If more valid prize claims for any prize are received than stated herein, all eligible claims for that prize will be combined in a random drawing to award the advertised number of prizes. Caution: Any attempt to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages or other remedies from and such person(s) responsible for the attempt to the fullest extend permitted by law. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. 7. Privacy: By entering the 2nd Chance Drawing, you agree to having the information submitted on the entry form to become part of a JCPenney database and are willing to accept future marketing information from JCPenney via email. Such information shall be maintained in accordance with JCPenney’s Privacy Policy, which is available through the JCPenney.com website. You will have the right, upon receipt of such email from JCPenney to "opt-out" (be deleted from) of the database and not receive any subsequent correspondence from JCPenney.
